FlunderLabs GmbH, Löwestraße 25, 10249 Berlin (hereafter “FlunderLabs“, “we“, “us”, “our") considers the protection of your data an integral part of our service. In this Privacy Policy, FlunderLabs would like to inform you when and what data is collected during the use of our service (hereafter “Cling”), why we need this data and whom we pass it on to. This Privacy Policy is accessible anytime at​

1. Area of Application and Controller

1.1 This Privacy Policy applies to all personal data collected by FlunderLabs during a visit to and the use of Cling.

1.2 FlunderLabs is the only controller (in terms of German Data Protection Laws) of the collection, processing and use of data (hereafter: data processing). Further detail is available on the imprint section of the website.

1.3 For the time being, FlunderLabs offers Cling in a test phase. Data collection during this phase can differ from collection during regular operation. A separate Privacy Policy applies for regular operation, which FlunderLabs will inform about towards the end of the test phase.

2. Data Processing by FlunderLabs

2.1 As a matter of principle, we only collect personal data if and when technically necessary. We do not use data for any other purpose, e.g. advertisement.

2.2 No data will be collected during a simple visit to the website.

2.3 To use Cling, you need to register a user account. This requires a Google account. With every log in, you IP address is stored for identification. See below for the use of cookies (see Nos. 4 and 5) and log files (see No. 6).

3. Intercom

We use the services of Intercom Inc., 55 2nd ST, 4th Floor, San Francisco, CA, 94105, USA (hereafter “Intercom”) as user helpdesk and to communicate with you either through e-mail or through messages within Cling. To this end, we transfer certain information about you (such as your name, e-mail address and sign-up date as well as information on your use of Cling). Intercom may amend this information with publicly available information about you, such as employer, job title, photos, website URLs, social network handles and physical addresses, to enhance your user experience. 4. Newsletter

To sign up for our newsletter, you have to provide an e-mail address. We will use such e-mail address to verify your subscription and hereafter, for the receipt of the newsletter. No further data is collected. You can revoke your consent for the use of your e-mail for the receipt of the newsletter at any time by clicking on the link in the newsletter to unsubscribe.

5. Cookies

5.1 Both our website and Cling use cookies. A cookie is a small text file with information, which is transmitted to the browser of the visitor. This file cannot contain any viruses and cannot read any information on your computer. By agreeing to the use of cookies in your browser, you do not put your computer at any risk. During your visit to the website, cookies which are technically required are placed as well as such that allow web analytics and optimization of the website.

​5.2. Technically required cookies are so-called session cookies and persistent cookies. A session cookie is technically required for the website to load and maintain connection. The persistent cookie set by us does not contain personal data but only stores the information that you have logged in successfully during the authentication process. This cookie is deleted automatically when you close your browser and will no longer be saved on your hard drive. In your browser settings, you can disable the use of cookies. In this case, Cling can no longer be used. However, the website will remain fully useable.

6. Google Analytics

6.1. We also use Google Analytics on our website, a web analytics service by Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA (hereafter: “Google“). Google Analytics uses so-called “cookies”, namely text files which are stored on your computer and allow analysis of how you use the website and Cling. The information on your usage created by the cookie are generally send to s server in the US and stored there.

6.2. However, before transmission by Google within European Union member states or in other member states of the European Economic Area, your IP address is shortened by Google and thus made anonymous. Only in exceptional cases a full IP address is transmitted to a server of Google in the US and shortened there. The IP anonymization is active in both our website and Cling. During analysis, your account ID is transmitted as a pseudonym, allowing Google allocation of your activities without allowing identification. On our instruction, Google will use such information to compile reports on the use of our website and Cling and to provide connected services to FlunderLabs.

6.3. Google will not connect the IP address transmitted by your browser in the context of Google Analytics and the pseudonymizated account ID will with any other data. You can prevent the use of cookies in your respective browser settings; however, we point to the fact that in this case you may not be able to make full use of all functions of the website and Cling. You can also prevent the collection of the data created by the cookie and of the data related to your use (including your IP address) and the processing of such data by Google by downloading and installing the browser plug in available at the following address:

6.4. The respective opt out cookie only applies to the browser used and only for our website and Cling. Whenever you delete cookies from your browser, you have to renew the opt out cookie. As an alternative to the browser add on, particularly on mobile devices, you can also prevent the processing by Google Analytics by setting an opt out cookie which prevents future data processing. 6.5. We further use Google Analytics to analyze data from DoubleClick cookies and AdWords for statistical purposes. If you do not want this, you can deactivate this feature here:

7. Log-Files

During every visit to our website and whenever you use a service, we automatically save a log file containing the following information: time stamp, method, request URL, size, status, response variable, user agent, remote IP, referrer, server IP and request parameters.

8. Social media log in

8.1. You can log into your user account using an existing social media account. If you chose this feature, you will be directed to the website of the respective social media platform, where you can log in with your log in data. This log in will allow the exchange of data between Cling and the social media platform. Hereby, we receive the following data from your profile: first name, last name and e-mail address.

8.2. We only use the data we need to identify you as a user. This is your name and your e-mail address. This information is mandatory for the execution of the contract.

9. Information Security

We secure our website, our service and other systems against loss, damage, unauthorized alteration and distribution of and unauthorized access to your data by technical and organizational measures. All data transmission is subject to encryption.

10. Correction, Blocking and Erasure

You may request information on all data stored on you free of charge. Under given circumstances, you may have a right to correction, blocking or erasure of this data.
